Terms
Purpose.
The Seller agrees to reserve the above property exclusively for the Buyer for the reservation window defined below, withdrawing it from any other negotiation, listing, or introduction during that period.

Reservation deposit.
Reservation window.
This reservation runs for 21 days from signature. By the end of that window, the parties commit to either sign the arras contract (contrato de arras penitenciales) or to mutually agree a one-time extension of up to 14 days.
The 21-day window is set to accommodate buyer-side NIE application, bank account opening, and source-of-funds verification — all of which PocketLister prepares in parallel through the AI Pilot.
Title due diligence.
The Seller agrees to deliver the current nota simple within seven (7) days of signature. The Buyer’s legal representative has the right to review the title and any registered cargas, liens or encumbrances during the reservation window. If a material defect is identified that the Seller cannot resolve within the window, the Buyer may withdraw and the reservation deposit is returned in full.
Arras contract.
At the end of the reservation window (or earlier by mutual agreement), the parties will sign a contrato de arras penitenciales committing to the full sale. The arras deposit will be 10% of the agreed sale price, less the reservation deposit already paid. The arras contract will set escritura within sixty (60) to ninety (90) days, to be agreed at that point.
PocketLister’s role.
PocketLister is not party to this contract. PocketLister provides the parties with the AI deal copilot, contract drafting, KYC packet, and legal hotline as defined in the Match Agreement. PocketLister’s fee under the Match Agreement is payable only on completion of the sale.
Governing law.
This contract is governed by Spanish law. Disputes are subject to the courts of Marbella.
